In California real estate litigation the lis pendens can be worse than the actual lawsuit that accompanies it. The lis pendens—or Notice of Pending Action—is sometimes used by less than scrupulous lawyers and litigants to stop a sale or frustrate a refinance as leverage to force a settlement. Although a lis pendens can be removed (“expunged”), it takes time and money.
