In the works...

We have filed suit for breach of contract, fraud and specific performance on behalf of a developer over the purchase of 5 acres of land after the seller misrepresented the zoning of the land. Laine Wagenseller will be a presenter at an all-day seminar entitled Real Estate Development from Beginning to End. Watch future announcements for more information. WLF recently settled a residential adverse possession case in mediation on favorable terms. The settlement came on the heels of our filing of a motion for summary judgment seeking a judgment of ownership as a matter of law.



In the News...

Man Real Estate Paper

The United States Supreme Court heard oral arguments in Kelo v. City of New London, in which homeowners are challenging the City's use of eminent domain powers to take their homes to give the land to commercial developers. The court will consider whether it should second guess the elected bodies decision and whether taking from one private owner to give to another private owner can be considered a 'public use.' A decision is expected in June.

Inside Courthouse

WLF was retained by a large construction company to pursue an unlawful detainer against a warehouse subtenant who had failed to pay rent and had gone into receivership. We negotatiated a full rent payment with the receiver and a set move out date, getting our client paid quickly with a minimum of costs. We are in the process of filing lawsuits against several industrial tenants of various landlords to collect past due rent.We are representing an entity involved in a corporate dissolution/partnership dispute. A restaurant client has hired WLF to negotiate its lease with a downtown landlord. We have also been retained to help with the assignment of a restaurant business in Alhambra. Several real estate buyers have called on us to review purchase and sale agreements and to investigate judgments affecting title and the purchase.
